UBER DRIVER RIGHTS: KNOW THE BASICS.

The landmark Supreme Court ruling is an important starting point — but individual circumstances still matter.

What did the Supreme Court decide?

In February 2021, the UK Supreme Court upheld the finding that drivers in the litigation were workers for relevant employment-law purposes rather than independent contractors as Uber had argued.

Worker status can carry protections including paid annual leave and national minimum wage. It does not automatically mean every driver has identical entitlements in every period or that every possible claim succeeds.

Questions worth checking

  • Which entity engaged you and what contractual terms applied?
  • What dates and working arrangements are relevant?
  • Have you already participated in litigation or reached a settlement?
  • What limitation periods might apply to your specific claim?

Employment tribunal deadlines can be short and depend on the type of claim. Seek prompt guidance from Acas, a trade union or an appropriately regulated legal adviser. Do not rely on a website headline as proof of eligibility.
